How to Register as a WA Seller of Travel

If you’re a travel agent or sell travel services in Washington, you’ll have to obtain a Seller of Travel endorsement. Here’s how it works:

What is a Seller of Travel?

“Seller of Travel” is a term used for a person or a business entity that sells or advertises travel, or travel-related services. For example, a travel agent would be considered a seller of travel. There are only five states that require travel-related businesses to register as a seller of travel: California, Florida, Hawaii, Iowa and Washington.

What is a Seller of Travel in Washington?

According to RCW § 19.138.021(6), a seller of travel in the state of Washington is “a person, firm, or corporation both inside and outside the state of Washington, who transacts business with Washington consumers.” This applies to travel agents (including independent contractors) or anyone who consults with or advises customers on travel arrangements or accommodations. However, if an individual seller of travel works for a business that is already registered as a seller of travel, that person would not need to also register individually. In Washington, the process of registering as a seller of travel is tied to obtaining a Business License.

Do I need to register as a Seller of Travel?

It depends. Some travel-related businesses aren’t required to register as sellers of travel. They include:

  • Air carriers
  • An owner or operator of some commercial vessels
  • Motor carriers
  • Rail carriers
  • Charter party carriers of passengers (as defined by RCW 81.70.020)
  • Auto transportation companies (as defined by RCW 81.68.010)
  • Hotels, or other lodging accommodations
  • Affiliates of sellers of travel
  • Direct providers of transportation (air, sea, ground) or lodging accommodation providers that do not otherwise book or arrange travel services

How do I register as a Seller of Travel in Washington?

In Washington state, “seller of travel” is categorized as a business endorsement. To register as a seller of travel, you’ll need to complete two steps:

It’s important to note that sellers of travel in Washington state are also required to maintain a trust account, or provide a Seller of Travel or Out-of-State Seller of Travel Surety Bond. Depending on your business’s location in Washington, you may also need to apply for other city or county endorsements.
