Do I have to register my non profit charity with the New Mexico Attorney General?
Yes. Charities that operate or seek contributions in New Mexico must register with the Attorney General, Charitable Organizations. Religious and Educational non profits do not have to register.
How do I register my non profit with the New Mexico Attorney General?
Charities are required to register and renew electronically. You will need to attach your corporate articles, bylaws and IRS forms and letters to the online form.
Are there annual renewal requirements for New Mexico charities?
Charities go to the AG Charitable Organization web portal and renew your registration for free by June 1st. We offer a link to the registration portal on our New Mexico Annual Report page.
What about the fundraisers that my non profit employs?
Professional fundraisers need to register, and annually renew by submitting the State of New Mexico Professional Fundraiser Form to the NM Attorney General. There is no fee. The form must be signed in front of a notary public. The registration form also includes a $25,000 surety bond. If the fundraiser is working in New Mexico, but is a resident of another state, he or she must designate the name and address of someone for accepting service of process; such as the registered agent of your New Mexico nonprofit.
How long does it take to process my New Mexico charity registration?
Even though charities register online and get an immediate confirmation receipt, it still takes approximately one month to review all the attached documents.
